The panel said the trial judge failed to inform defense lawyers that a foreperson had expressed concerns that a juror didn't understand English well enough to participate in deliberations. The panel ordered that the renowned cancer expert, serving 11 years for sexual battery and sexual penetration of patients, be retried.
